Welcome to Gulf Monger and our Terms of Use (these “Terms”). Gulf Monger is a brand of Pippin Consulting Group, a Florida company doing business as Gulf Monger (“Gulf Monger,” “we,” “us,” or “our”). These Terms are important and affect your legal rights, so please read them carefully. Note that Section 17 of these Terms contains a mandatory arbitration provision that requires the use of arbitration on an individual basis and limits the remedies available to you in the event of certain disputes.

By accessing or using gulfmonger.com (the “Site”) or placing an order for Gulf Monger products—whether online, in person at a farmers market, or through Shopify Point of Sale—you agree to be bound by these Terms and all terms incorporated herein by reference, including our Privacy Policy. If you do not agree, do not access or use the Site or place an order.

Gulf Monger reserves the right to change or modify these Terms at any time. We will notify you of material changes by email or by updating the “Last Updated” date above. Continued use of the Site or placing an order after such notice constitutes acceptance of the revised Terms.

1. Privacy Policy

Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. The Privacy Policy is incorporated into these Terms by reference.

2. Eligibility

The Site is intended for use by individuals 18 years of age or older who are legal residents of the United States. By using the Site, you represent and warrant that you:

  • are 18 years of age or older;
  • are a legal U.S. resident;
  • have not been previously suspended or removed from the Site;
  • do not maintain more than one Gulf Monger account; and
  • have full power and authority to enter into these Terms without violating any other agreement to which you are a party.

3. Registration, Account and Communication Preferences

To access certain features of the Site, you may register for a Gulf Monger account. By creating an account, you agree to:

  • provide accurate, current, and complete information;
  • maintain and promptly update your account information;
  • maintain the security of your credentials;
  • be responsible for all activity under your account; and
  • immediately notify us of any security breach at jeff@gulfmonger.com.

By creating an account or placing an order, you consent to receive electronic communications from Gulf Monger, including order confirmations, shipment updates, and account notices. Electronic communications satisfy any legal writing requirement. You may opt out of promotional emails at any time by following the unsubscribe instructions.

SMS / Text Message Marketing

With your prior express written consent collected on our Site, Gulf Monger and its agents may contact you via SMS/text message. By consenting to receive text messages, you may receive: (1) transactional messages—order confirmations, shipment tracking, and delivery updates; and (2) promotional messages—catch announcements, exclusive offers, and seasonal promotions.

Your consent to receive text messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply—check your wireless plan for details. To opt out of promotional texts at any time, reply STOP. For help, reply HELP or contact us at jeff@gulfmonger.com. Gulf Monger and carriers are not liable for delayed or undelivered messages.

4. Geographic Availability

Gulf Monger currently delivers to the South Tampa area only. The Site may reference products or services that are not available in all locations. A reference to a product does not guarantee its availability in your area or at the time of your order. Gulf Monger intends to expand its delivery range over time.

5. Terms of Sale

5.1 Subscriptions

Gulf Monger offers monthly and bi-monthly subscription plans (each, a “Subscription”). Subscriptions may be customer-curated (you select species) or captain’s-choice boxes (we select based on availability and catch). The amount you are charged and the seafood you receive may vary based on your selections and product availability.

WHEN YOU REGISTER FOR A SUBSCRIPTION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (A) GULF MONGER (OR OUR THIRD-PARTY PAYMENT PROCESSOR, SHOPIFY PAYMENTS) IS AUTHORIZED TO CHARGE YOU ON A RECURRING BASIS FOR YOUR SUBSCRIPTION, INCLUDING ANY APPLICABLE TAXES AND CHARGES, FOR AS LONG AS YOUR SUBSCRIPTION REMAINS ACTIVE; (B) THE AMOUNT YOU ARE CHARGED AND THE SEAFOOD YOU RECEIVE MAY VARY BASED ON YOUR PREFERENCES; (C) YOU MAY CANCEL AT ANY TIME VIA YOUR ACCOUNT SETTINGS OR BY EMAILING JEFF@GULFMONGER.COM, PROVIDED YOU CANCEL AT LEAST THREE (3) DAYS BEFORE YOUR NEXT BILLING DATE TO AVOID THE NEXT CHARGE; AND (D) YOUR SUBSCRIPTION IS CONTINUOUS UNTIL YOU CANCEL IT OR WE SUSPEND OR TERMINATE IT IN ACCORDANCE WITH THESE TERMS.

Florida Automatic Renewal Disclosure: In accordance with Florida Statute Section 501.165, Gulf Monger subscriptions automatically renew at the end of each subscription period at the then-current rate until canceled. The charge date, frequency, and cancellation instructions are provided at checkout and in your order confirmation email.

5.2 Cancellation Policy

YOU MAY CANCEL YOUR SUBSCRIPTION AT ANY TIME BY CONTACTING US AT JEFF@GULFMONGER.COM OR THROUGH YOUR ACCOUNT SETTINGS. TO AVOID BEING CHARGED FOR AN UPCOMING ORDER, YOU MUST CANCEL AT LEAST TWO (2) DAYS BEFORE YOUR SCHEDULED SHIP DATE. ANY ORDER WITHIN TWO (2) DAYS OF ITS SCHEDULED SHIP DATE, OR IDENTIFIED AS ORDER PROCESSED OR SHIPPED, CANNOT BE CANCELLED AND WILL BE CHARGED IN FULL. YOU WILL BE RESPONSIBLE FOR ALL CHARGES INCURRED WITH RESPECT TO ANY ORDER PROCESSED PRIOR TO CANCELLATION.

Canceling your Subscription does not affect your right to receive promotional communications, which you may separately opt out of at any time.

5.3 One-Time Orders

Gulf Monger also accepts one-time orders with no subscription required. One-time orders are subject to all applicable provisions of these Terms, including payment, shipping, delivery, and refund policies.

5.4 Payment and Billing

Payments are processed through Shopify Payments. By providing a payment method, you represent that you are authorized to use it and you authorize Gulf Monger (or Shopify Payments) to charge it for the total amount of your order, including applicable taxes and shipping. If your payment method is declined or invalid, your order may be suspended or canceled. You remain responsible for uncollected amounts.

For Subscriptions, billing occurs on a recurring basis as disclosed at checkout. You may update your payment method at any time through your account settings. Gulf Monger reserves the right to retry failed payments using any valid payment method on file.

5.5 Pricing and Availability

All prices are listed in U.S. dollars. Applicable taxes and shipping charges, if any, are additional and shown at checkout. Gulf Monger reserves the right to adjust prices at any time; however, if Subscription pricing changes, we will provide at least thirty (30) days’ advance written notice (by email) prior to your next billing cycle. You may cancel your Subscription before the new pricing takes effect if you do not accept the change.

All products are subject to availability. Gulf Monger reserves the right to impose quantity limits, reject or cancel orders, discontinue products, and substitute species without prior notice. Given the perishable nature of wild-caught seafood and the variability of federally managed fisheries, substitutions may occur from time to time. 5.6 Taxes

Gulf Monger will collect applicable Florida sales tax and any other required sales tax on products shipped to states where we have a duty to collect. The amount of tax shown at checkout may be adjusted due to changes in tax rates or product classifications.

5.7 Shipping and Handling

Gulf Monger fulfills all orders from its own facility. Delivery is made through one of the following methods depending on your location and order type:

  • Carrier Shipments: Orders shipped outside the local delivery area are shipped via FedEx or UPS. Shipping times shown at checkout are estimates only; actual delivery dates may vary.
  • Local Delivery (South Tampa area): Local orders may be delivered personally by Gulf Monger or through Gulf Monger’s local delivery partners. Estimated delivery windows will be communicated at time of order.

You agree not to obtain or direct shipment of a product for export outside the United States.

Risk of Loss: For carrier shipments (FedEx or UPS), title to and risk of loss passes to you upon Gulf Monger’s delivery of the product to the carrier. For local deliveries completed by Gulf Monger or a Gulf Monger delivery partner, risk of loss passes to you upon delivery to your designated address. Gulf Monger will work with you in good faith to address documented issues with lost or damaged shipments.

Gulf Monger reserves the right to adjust shipping and delivery dates when, in its sole discretion, doing so serves a business purpose or benefits customers.

5.8 Deliveries and Cold Chain

Gulf Monger ships its Frozen Fresh products—processed and vacuum-sealed within 24 hours of landing and frozen at -5°F—using insulated packaging designed to maintain product integrity during transit. Local deliveries are packaged with gel packs; non-local shipments include dry ice.

Dry Ice Handling: If your order includes dry ice, handle it with care at all times. Wear protective cloth or leather gloves when touching dry ice. Prolonged contact with skin will cause injury similar to a burn. Dispose of dry ice in a well-ventilated area; do not place it in a sealed container.

Customer Responsibility Upon Delivery: You are responsible for inspecting all products upon delivery and for ensuring immediate proper storage. Gulf Monger’s engineered cold chain is designed to maintain product quality during transit; however, once delivered, responsibility for product condition passes to you. If you are not present when your delivery arrives, the carrier will generally leave the package at your door. Gulf Monger is not responsible for product quality degradation resulting from failure to retrieve and store your order promptly after delivery. Any individual at the delivery address who accepts a delivery is presumed authorized to receive it.

We recommend that you:

  • immediately freeze or refrigerate all products upon delivery;
  • use a thermometer to verify safe internal temperature before consumption; and
  • follow USDA safe food handling guidelines available at fsis.usda.gov.

Failure to follow safe food handling practices may increase the risk of foodborne illness. Pregnant women, young children, the elderly, and individuals with compromised immune systems should follow FDA guidelines for at-risk groups.

In the case of inclement weather or carrier delays beyond our control, Gulf Monger will attempt delivery as soon as reasonably possible and may issue a store credit or refund for affected orders at its sole discretion.

5.9 Returns, Replacements, and Refunds

Gulf Monger does not accept returns of perishable seafood products. Because all products are wild-caught, frozen, and perishable, all sales are final unless a product arrives in unsatisfactory condition.

If you believe a product arrived damaged, spoiled, or otherwise not as intended, you must contact us at jeff@gulfmonger.com within seven (7) days of delivery. To process your claim, we require all of the following:

  • A photo or short video of the unopened box upon receipt;
  • A photo of the product showing the condition issue; and
  • A photo of a thermometer reading taken at the time of inspection.

Gulf Monger will review submitted documentation and, in its sole discretion, may provide a full replacement order or a full refund of the purchase price for the affected product. Gulf Monger reserves the right to deny claims that do not include the required documentation or where the evidence indicates the issue arose after delivery.

Non-perishable merchandise (branded items, apparel, and accessories) may be returned within 30 days of delivery if unused and in original packaging. Contact jeff@gulfmonger.com for return instructions. You are responsible for return shipping costs unless the item was defective or incorrectly fulfilled.

5.10 In-Person and Farmers Market Sales

All sales made in person—including at farmers markets, local pickup locations, and any other in-person point-of-sale—are final. No returns, refunds, or exchanges will be offered for in-person purchases of perishable seafood products, EXCEPT IN THE EVENT THAT A PRODUCT IS FOUND TO BE SPOILED OR UNFIT FOR CONSUMPTION AT THE TIME OF PURCHASE.

By completing an in-person transaction, you accept the product in its current condition, subject to the aforementioned exception for merchantability and quality at the time of sale. Gulf Monger will maintain a separate In-Person Purchase Policy available at point of sale for reference. In the event of a conflict between these Terms and the In-Person Purchase Policy with respect to in-person transactions, the In-Person Purchase Policy governs.

6. License to Access and Use the Site and Content

Unless otherwise indicated, the Site and all content—including the Gulf Monger name, “Frozen Fresh” tagline, logo, designs, text, graphics, photos, audio, video, and other materials (collectively, “Content”)—are the proprietary property of Pippin Consulting Group or its licensors and are protected by U.S. and international copyright and trademark law.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and Content for personal, non-commercial purposes only. This license does not permit you to:

  • sell or commercially use the Site or Content;
  • publicly display or distribute Content;
  • create derivative works;
  • use data mining or scraping tools; or
  • use the Site or Content outside their intended purpose.

Any unauthorized use terminates this license immediately.

7. Intellectual Property and Copyright

The Gulf Monger name and logo are trademarks of Pippin Consulting Group (DBA filed, State of Florida). “Frozen Fresh” is a proprietary tagline of Gulf Monger. Nothing in these Terms grants any right or license to use Gulf Monger’s name, logo, or proprietary taglines without prior written permission.

Gulf Monger respects intellectual property rights. If you believe that content on the Site infringes your copyright, please send a written notice to:

Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your signature. See 17 U.S.C. § 512(c)(3) for full requirements.

8. Third-Party Content and Links

The Site may contain links to third-party websites or display third-party content. Gulf Monger does not control, endorse, or adopt any third-party content and makes no representations regarding its accuracy. When you leave the Site, Gulf Monger’s Terms and policies no longer apply. Review the applicable terms of any third-party site before engaging with it.

9. User Conduct

By using the Site, you agree not to:

  • violate any applicable law, regulation, or third-party right;
  • use another user’s account without authorization; or
  • disrupt, disable, or impair the Site or its servers.

10. User Content

The Site allows customers to post product reviews and related content (collectively, “User Content”). You are solely responsible for your User Content and represent that it reflects your honest experience. By submitting User Content, you agree not to post content that:

  • is false, misleading, defamatory, obscene, or harassing;
  • infringes any intellectual property or privacy right;
  • contains unsolicited promotions or spam;
  • includes personal information of a third party without consent; or
  • violates any applicable law.

Pippin Consulting Group reserves the right to remove User Content that is unlawful, libelous, harassing, obscene, vulgar, contains personal information of another person, is clearly false or misleading, or contains computer viruses. Pippin Consulting Group will not remove content solely because it is critical of our products or services, in compliance with the Consumer Review Fairness Act.

11. Rights in User Content

You retain ownership of your User Content. By submitting User Content to the Site or to Gulf Monger’s social media pages, you grant Gulf Monger a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content and your name and likeness associated with it, for any purpose including commercial, promotional, and marketing purposes.

You represent that: (a) your User Content is non-confidential; (b) you own or have the rights to post it; (c) it is accurate and not misleading; and (d) its posting does not violate these Terms or any applicable law.

12. Feedback

Any suggestions, ideas, or feedback you submit to Gulf Monger become the sole property of Gulf Monger. Gulf Monger may use Feedback for any purpose without acknowledgment or compensation to you.

13. Food Safety, Allergens, and Regulatory Compliance

Gulf Monger operates under a HACCP (Hazard Analysis and Critical Control Points) food safety plan and holds Florida Department of Agriculture and Consumer Services (FDACS) Special Process Approval for refrigerated, oxygen-packaged fish products. All wild-caught seafood offered through Gulf Monger is sourced from federally managed Gulf fisheries under NOAA oversight.

YOU ARE SOLELY RESPONSIBLE FOR THE SAFE HANDLING, STORAGE, PREPARATION, AND CONSUMPTION OF ALL PRODUCTS YOU RECEIVE. YOU ASSUME ALL RISKS RELATED TO FOOD HANDLING AFTER DELIVERY.

Allergen Notice: Gulf Monger products contain fish and shellfish. If you have a seafood allergy, do not order from Gulf Monger. We cannot guarantee that cross-contamination will not occur during processing or packaging.

At-Risk Groups: Pregnant women, young children, the elderly, and individuals with compromised immune systems should consult FDA guidelines for at-risk groups before consuming raw, undercooked, or vacuum-packaged seafood.

14. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Pippin Consulting Group, its members, officers, employees, agents, contractors, successors, and assigns (collectively, the “Gulf Monger Parties”) from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Site or products; (b) your User Content; (c) your Feedback; (d) your violation of these Terms; or (e) your violation of the rights of any third party.

15. Disclaimers

EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE SITE, CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GULF MONGER DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GULF MONGER ATTEMPTS TO DISPLAY PRODUCTS AND PRICING ACCURATELY BUT DOES NOT GUARANTEE THE ACCURACY OF SUCH INFORMATION. IN THE EVENT OF AN ERROR, GULF MONGER RESERVES THE RIGHT TO CORRECT THE ERROR, CANCEL YOUR ORDER AND ISSUE A FULL REFUND, OR CONTACT YOU TO PROPOSE A REVISION TO YOUR ORDER WHICH SHALL ONLY BE PROCESSED UPON YOUR CONSENT.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE GULF MONGER PARTIES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SITE OR CONTENT; (B) THE ORDER, RECEIPT, OR USE OF ANY PRODUCT; OR (C) THESE TERMS, REGARDLESS OF THE FORM OF ACTION OR THE THEORY OF LIABILITY, EVEN IF GULF MONGER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GULF MONGER’S MAXIMUM AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR (B) $250.

NOTHING IN THIS SECTION 16 SHALL LIMIT OR EXCLUDE LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE DIRECTLY CAUSED BY PRODUCTS YOU PURCHASED FROM GULF MONGER, OR FOR FRAUD, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT.

17. Dispute Resolution; Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES ARBITRATION OF DISPUTES ON AN INDIVIDUAL BASIS AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

17.1 Binding Arbitration

Except for disputes where either party seeks injunctive or other equitable relief for alleged unlawful use of intellectual property, or disputes that qualify for small claims court, you and Gulf Monger agree to resolve all disputes exclusively through binding individual arbitration. You waive the right to have disputes resolved by a judge or jury.

17.2 No Class Actions

All disputes must be resolved on an individual basis. No arbitration or claim may be brought as a class action, class arbitration, or representative proceeding. The arbitrator may not consolidate claims of more than one individual.

17.3 Federal Arbitration Act

These Terms affect interstate commerce. The enforceability of this Section 17 is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., to the maximum extent permitted by law.

17.4 Notice and Informal Resolution

Before initiating arbitration, the complaining party must send written notice of the dispute to the other party. Notice to Gulf Monger must be sent to jeff@gulfmonger.com with: (a) your name, address, and account email; (b) a description of the dispute; and (c) the specific relief sought. The parties will attempt to resolve the dispute informally for 30 days after notice is received. If unresolved, either party may commence arbitration.

17.5 Arbitration Process

Arbitration will be conducted by a single arbitrator in Hillsborough County, Florida under the Commercial Arbitration Rules of the American Arbitration Association (AAA), which are available at adr.org. Any dispute must be filed within the applicable statutory period provided by Florida law, or it is permanently barred. The state and federal courts of Florida, sitting in Hillsborough County, have exclusive jurisdiction over appeals and enforcement of any arbitration award.

17.6 Opt-Out Right

You may opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice to jeff@gulfmonger.com. Your notice must include your full name and a clear statement of your intent to opt out. If you opt out, disputes will be resolved as provided in Section 18.

18. Governing Law and Venue

These Terms and any dispute arising from your use of the Site or purchase of products shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida. You consent to the personal jurisdiction of those courts.

Nothing in these Terms limits Gulf Monger’s rights under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) or any other applicable consumer protection law.

19. Termination

Gulf Monger reserves the right, in its sole discretion, to suspend or terminate your account and access to the Site at any time and for any reason, without notice. Upon termination or suspension of your account, Pippin Consulting Group will fulfill or refund any pending orders for which you have already paid, but you will not be entitled to a refund of any other amounts already paid, to the fullest extent permitted by applicable law.

20. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

21. Survival

Sections 6, 7, 10, 11, 12, 13, 14, 15, 16, 17, 18, 20, 21, and 22 survive the expiration or termination of these Terms and any Gulf Monger account.

22. Miscellaneous

These Terms constitute the entire agreement between you and Gulf Monger with respect to the subject matter herein and supersede all prior and contemporaneous understandings. Gulf Monger’s failure to enforce any right or provision of these Terms shall not constitute a waiver. These Terms may not be assigned by you without Gulf Monger’s prior written consent. Gulf Monger may assign these Terms freely. These Terms are for the benefit of the parties only and do not confer any third-party beneficiary rights.
